According to Section 1(4) of the British Nationality Act 1981, children born in the UK to non-British or non-settled parents may be eligible for British citizenship. To qualify, the child must not have spent more than 90 days outside the UK in each of the first ten years of their life.

Requirements to register a child born in the UK as a British citizen after 10 years

Requirements for British Citizenship for Children Born in the UK

Generally, a child must demonstrate the following to qualify for British citizenship:

  • Birth: Born in the United Kingdom on or after January 1, 1983.
  • Age: 10 years of age or older.
  • Absence: No more than 90 days outside the United Kingdom in each of the first 10 years of life.
  • Character: Good character.

Exceptions to the 90-Day Rule:
In certain circumstances, the Home Office may waive the 90-day absence requirement. If you’ve exceeded this limit but believe there are special circumstances, be sure to explain them on your application form.

While parental consent is generally advisable for child citizenship applications, its absence should not be a reason for refusal if the applicant meets all other eligibility requirements. Gaining consent from all those with parental responsibility is good practice and should typically be requested, but it’s not mandatory.

If parental consent is not obtained, it should not be grounds for denying the application.
